Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Gova Creative LLC (“we,” “us”) and apply to the Strivora app for iPhone and Apple Watch and the website strivoratracker.com (together, “Strivora”). By downloading, accessing or using Strivora, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use Strivora.

1. Who can use Strivora

You must be at least 18 years old and able to form a binding contract. By using Strivora you confirm that you meet these requirements.

2. Not medical advice

Strivora provides general nutrition, fitness and lifestyle information for educational purposes only. Nothing in Strivora, including calorie, protein, carbohydrate and water targets, diet plans, fasting schedules, meal ideas, recipes, tips or weekly adjustments, is medical advice, diagnosis or treatment, and it is not a substitute for care from a physician, registered dietitian or other qualified health professional.

Consult your doctor before using Strivora or starting any diet, fasting or exercise plan, especially if you take a GLP-1 or any other medication; have diabetes or a heart, kidney, liver, thyroid or other medical condition; are pregnant, planning a pregnancy or breastfeeding; have a history of disordered eating; or are under a doctor’s care. Never start, change or stop a medication based on anything in Strivora. If you feel unwell, stop and seek medical attention. In an emergency, call 911.

Targets are estimates based on standard formulas and the information you enter, and food data comes from third-party databases that may be incomplete or inaccurate. Results vary, and we do not promise any particular result. The first time you open the app, you are asked to read and sign a Health & Safety Acknowledgment, which forms part of these Terms.

3. Your choice and assumption of risk

You choose to use Strivora and its diet plans voluntarily and of your own free will. Changing your diet, fasting and exercising involve risks, including risks to your health. You are responsible for the decisions you make, and to the fullest extent permitted by law you assume those risks.

4. Your account

You may sign up with an email address and password or with Sign in with Apple. Give accurate information, keep your login secure and tell us if you think your account has been used without permission. You can delete your account and its data at any time in the app under Me → Delete account.

5. Strivora Premium, subscriptions and billing

• Strivora is free to download. Strivora Premium is an optional auto-renewing subscription, offered monthly or yearly. Prices are shown in the app before you buy and may vary by country or change over time.
• Payment is charged to your Apple ID when you confirm your purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in your iPhone Settings → [your name] → Subscriptions. Deleting the app or your account does not cancel a subscription.
• If a free trial is offered, any unused portion ends when you purchase a subscription. If you don’t cancel before the trial ends, the subscription begins and you are charged.
• All payments are processed by Apple. Refund requests are handled by Apple under its policies at reportaproblem.apple.com.

6. Acceptable use

Don’t misuse Strivora. For example, don’t: break the law; access another person’s account or data; interfere with or disrupt Strivora or its servers; copy, reverse engineer or resell Strivora except where the law allows; use automated tools to scrape or overload Strivora; or upload anything unlawful, harmful or that you don’t have the right to share.

7. Your content and data

You own the information you enter into Strivora, such as your food log, weigh-ins, notes and photos. You give us permission to store, process and display that information only as needed to run Strivora for you. How we handle your information is described in our Privacy Policy.

8. Third-party services

Strivora relies on services from other companies, including Apple (App Store, Sign in with Apple and Apple Health), Google (Firebase and AdMob), the U.S. Department of Agriculture’s FoodData Central and Open Food Facts. Your use of those services may be subject to their own terms. We are not responsible for third-party services or the accuracy of third-party data.

9. Our intellectual property

Strivora, including its name, logo, design, text, graphics and software, belongs to Gova Creative LLC or its licensors and is protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use Strivora for your own non-commercial use, in line with these Terms.

10. Disclaimers

To the fullest extent permitted by law, Strivora is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that Strivora will be uninterrupted, error-free or secure, or that any information in it is complete or accurate.

11. Limitation of liability

To the fullest extent permitted by law, Gova Creative LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any injury, illness, loss or damage arising from your use of, or reliance on, Strivora or its content. Our total liability for any claim relating to Strivora will not exceed the greater of the amount you paid for Strivora in the 12 months before the claim or US $50. Some places don’t allow certain limitations, so some of these may not apply to you, and nothing in these Terms limits rights that cannot be waived under applicable law.

12. Indemnity

To the extent permitted by law, you agree to defend and hold harmless Gova Creative LLC and its owners, employees and partners from claims, losses and expenses (including reasonable legal fees) arising from your misuse of Strivora or your violation of these Terms.

13. Ending your use

You can stop using Strivora at any time. We may suspend or end your access if you violate these Terms or if we stop offering Strivora. Sections that by their nature should continue, such as disclaimers and limitations of liability, survive.

14. Changes to Strivora and these Terms

We may update Strivora and these Terms from time to time. If we make material changes, we will update the date above and let you know in the app or on this page before they take effect. Continuing to use Strivora after changes take effect means you accept them.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, except where the law of your place of residence requires otherwise.

16. Apple App Store terms

If you downloaded Strivora from the Apple App Store, you also agree to the following:

• These Terms are between you and Gova Creative LLC only, not Apple. Gova Creative LLC, not Apple, is solely responsible for Strivora and its content.
• Your license to use Strivora is limited to use on Apple-branded products you own or control, as permitted by the App Store’s Usage Rules.
• Apple has no obligation to provide maintenance or support for Strivora.
• If Strivora fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Strivora.
• Gova Creative LLC, not Apple, is responsible for addressing any claims relating to Strivora or your use of it, including product liability claims, claims that Strivora fails to meet legal or regulatory requirements, and consumer protection or similar claims.
• If a third party claims that Strivora infringes its intellectual property rights, Gova Creative LLC, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
